Conditions of Tours

The tour companies; Pemberton Discovery Tours, Pemberton Hiking Company, Poachers Apprentice and Strungout Adventures, hereby mentioned as 'the tour companies', reserve the right to alter, defer, cancel any or all of a tour due to unforeseen circumstances i.e. weather, road conditions or in the case of mechanical break down etc.

Customers are strongly encouraged to take out personal travel insurance.

The tour companies can not guarantee exact tour times and can not be held responsible for failure to connect with other services.

The tour companies reserve the right to employ guides other than those advertised should the need arise.

It is the customers responsibility to inform the guide before the tour if they feel they can not partake in any of the activities described by the guide i.e. swimming, walking, climbing etc

The tour companies reserve the right to refuse any person from partaking in a particular activity if they are deemed unfit, unsuitable or refuse to follow safety instructions or wear correct safety gear.

There is an element of risk in all activities, these risks can be lowered if customers abide by rules set out by the guide, and use common sense.

The client must understand and accept that the tour companies, their employees, subsidiaries and agents, is not a carrier or hotelier, nor does it own aircraft or hotels. They takes every care in the selection of carriers, hotels, coach operators, driver/guides, and the suppliers of hire vehicles and other travel services used in adventure tours (all of which are hereafter referred to as "the other suppliers").

The client must understand and accept that all bookings made with the tour companies are subject to the terms and conditions and limitations and liability imposed by the other suppliers, some of whom limit or exclude liability in respect to death, personal injury or delay.

The client  must understand and accept that the tour companies are not in any way liable for the acts, omissions or default whether negligent or otherwise, of the other suppliers.

These terms and conditions are incapable of alteration or waiver by a servant, agent or representative of the tour companies or by any other supplier.

Notwithstanding anything contained in this Agreement to the contrary, the tour companies shall not be liable for any loss, injury, delay, damage or other casualty suffered or incurred by you due to storms, fires, earthquakes, explosions, embargoes, Government directives, or any other law or regulation, litigation or labour dispute, act of God, war, terrorism, or any other cause which is beyond our reasonable control.

This Agreement is and shall be governed by and construed in accordance with the law of the State of Western Australia.

Any legal conflict which may arise under this Agreement shall be resolved in the legal jurisdiction of Western Australia.

If you are booking a 4WD Tag along tour with Pemberton Discovery Tours, these conditions must also be agreed to:

  1. For tag along tours the driver must confirm that they and any co-drivers possess a driver's license valid in Australia.

  2. For tag along tours the tour price does not include the cost of any vehicle repairs or towing expenses.

  3. For tag along tours the driver will be liable for all traffic offences incurred during the tour.

  4. Pemberton Discovery Tours recommends that you have some form of vehicle insurance (in addition to third party).

  5. The client must agree to observe the safety and other instructions of the authorised tour leader/guide for the duration of the tour.

I am aware that Off-road, four wheeled driving holds certain risks and I do hereby assume all responsibility of risk and release Pemberton Discovery Tours, staff and associates from all liability, actions, causes of action, debts, claims and demands of every kind and nature whatsoever which I now have or which may arise out of or in connection with this tour. The terms hereof shall serve as a release of risk for any heirs, executors and administrators and all members of my family, including any minors accompanying me, with me acting as their guardian.

Cancellation Policy

Tours are booked directly or through a second party (eg Tourist Centre).

Deposits are required from all prearranged tours. A $50 cheque or 50% of the total is a minimum.

Prepaid bookings, which are cancelled 4 days (or more) prior will receive a full refund unless the booking is greater than 8 people – in which case the deposit may be forfeited.

Prepaid bookings that are cancelled more than 1 and less than 3 days prior will receive their deposit less a $10 booking fee

Prepaid bookings which are cancelled on the last day – through no fault of Pemberton Discovery Tours – will lose their deposit.

Cancellation Fee’s, that are lost as a means of above, may be used as a deposit on another booking at a different time.

These fee’s as mentioned above do not include travel agents cancellation fee’s – these must be added to the cancellation fee’s mentioned above.

  1. To make a booking, client/agent must provide the tour company with a verbal or written booking, along with a $50 deposit payable to the tour company in question by bank/business cheque, international money order, or credit card (Visa, Bankcard or Master Card).
  2. A booking is accepted when confirmation by the tour company.
  3. Should it be necessary to cancel your tour, you must notify the tour company immediately. The notification will take effect the day it is received by the tour company.
  4. All monies less the deposit will be refunded when the tour is cancelled more than 24 hours prior to the tour unless the tour is a special organised tour involving third parties and suppliers where their cancellation fees must also be met.
  5. The deposit may be used as a deposit on another booking at a different time at the tour companies discretion.
  6. When a cancellation is done through a travel agents the the travel agents cancellation fee must be added to the deposit
  7. The non-issuance of an invoice or the non-payment and/or non-receipt of an invoice will not exempt participants from the cancellation penalties contained herein.
